Estate Planning for La Cañada Flintridge Families With a Home to Protect

For most California families, the house is the largest thing they own, and it’s usually the first thing a good estate plan needs to protect. I help La Cañada Flintridge homeowners decide who should receive the home, how it should pass, and what it could cost their family if they handle it the wrong way. A good plan answers those questions now, in plain English, so the people you love aren’t left guessing later.

If My Children Inherit the House, Will They Keep My Property Tax Rate?

Not automatically, and this surprises a lot of homeowners. Since 2021, California lets a child keep a parent’s lower property tax value only when the home becomes that child’s primary residence, and only up to a cap of roughly $1 million above the home’s current taxable value.

A child who doesn’t move in, or who rents the house out, can see it reassessed at today’s market value, and the tax bill can jump. The details and the timing of the paperwork both matter. Before deciding how to leave your home, we look at its taxable value, what it’s worth now, and which child, if any, would realistically live there.

Should I Just Add My Child to the Deed?

It looks like the easy fix, and I understand why people consider it. But adding a child to your deed is a gift of part of your home. It can affect your property taxes, it can leave your child with a larger capital gains bill when they sell, and it exposes that share of the house to your child’s own debts, divorce, or lawsuits. There are usually better tools, and the right one depends on your family. Before you sign a new deed, let’s talk it through.

What Happens to the House If There’s No Plan?

Without a will or living trust, California law decides who inherits, and the house often has to go through probate, a public court process that commonly takes a year or more. The fees are set by statute and based on the gross value of the estate, not what you own free and clear.

On a $1 million home, the attorney’s fee and the executor’s fee each come to $23,000, mortgage or not. A living trust can usually let the house pass to your family without that process.

What to Bring: Your Deed and Your Latest Property Tax Bill

Your first meeting is free. To make it count, bring a copy of your deed, your most recent property tax bill, and any wills, trusts, or beneficiary forms you already have. The tax bill shows your home’s assessed value, which is the number that matters most when we talk about what your children could face later.

If you can’t find the deed, we’ll sort that out together. We’ll talk about whom you want to protect, what you own, and what would happen today if something went wrong, and I’ll tell you honestly what you need and what you don’t.
